1. Agreement to Terms
By purchasing and using Current AI Solutions' services ("Services"), you ("Client") agree to be bound by these Terms of Service. If you do not agree to these terms, do not proceed with payment or use of the Services.
2. Service Description
Current AI Solutions provides AI-powered receptionist services that handle incoming calls, answer enquiries, book appointments, and manage customer communications for your business 24/7/365.
3. Pricing and Payment Terms
3.1 Fees
- Monthly Subscription: $797 AUD per month (GST inclusive)
- One-Time Setup Fee: $999 AUD (non-refundable)
- Included in Monthly Fee:
- 24/7 AI receptionist trained on Client's business
- 800 minutes of AI talk time per month
- Email summaries after every call
- Calendar integration and automated appointment booking
- Access to CRM system (view contacts and conversation transcripts)
- FAQ answering capabilities
- Custom AI training on Client's services and pricing
- Priority support
- Additional Charges: Inbound call minutes beyond included AI talk time are charged separately at cost based on telecommunications provider rates
- All fees stated are inclusive of GST where applicable
3.1a Usage and Minutes
- "Minutes" refers to total AI conversation time (talk time with the AI receptionist)
- 800 minutes is equivalent to approximately 13 hours of AI conversation per month
- Most businesses use between 200-400 minutes per month
- Additional inbound telecommunications minutes (phone line usage) are charged separately at telecommunications provider rates
- Client will receive detailed usage reports with each monthly invoice
- Usage is calculated based on actual conversation time, not call duration (hold time, transfers, etc. are excluded)
3.2 Setup Fee
The setup fee covers:
- Custom AI training on your business
- Integration with your existing systems (booking, CRM, etc.)
- Phone number setup and configuration
- Initial testing and optimization
- Onboarding support
The setup fee is non-refundable once onboarding has commenced. Onboarding is considered commenced upon payment receipt.
3.3 Monthly Billing
- Monthly subscription begins on the date your AI receptionist goes live
- Billing occurs on the same calendar day each month thereafter
- Payment is due in advance via automatic debit/credit card charge
- First month is charged at setup completion; subsequent months charge automatically
3.4 Failed Payments
- If payment fails, Services may be suspended after 7 days
- A $50 failed payment fee applies to each failed transaction
- Account reactivation requires payment of all outstanding amounts plus failed payment fees
- After 30 days of non-payment, your account will be terminated and setup fee is forfeited
3.5 Price Changes
Current AI Solutions reserves the right to change pricing with 60 days written notice to Client. Price changes do not apply retroactively.
4. Service Term and Cancellation
4.1 Initial Term
Services continue on a month-to-month basis until cancelled by either party.
4.2 Cancellation by Client
- Client may cancel at any time with 30 days written notice to [email protected]
- Cancellation must be received before the next billing date to avoid charges
- Monthly fees are non-refundable for the current billing period
- Service continues until the end of the paid period
- Setup fee is non-refundable under any circumstances
4.3 Cancellation by Current AI Solutions
We reserve the right to terminate Services immediately if:
- Client breaches these Terms
- Client uses Services for illegal purposes
- Client's account remains unpaid for 30+ days
- Client engages in abusive behavior toward our team
5. Service Level and Uptime
5.1 Availability Target
We target 99% uptime for AI receptionist services, excluding scheduled maintenance.
5.2 No Guarantee of Results
While we optimize AI performance, we do not guarantee specific business outcomes (revenue increase, call conversion rates, etc.). Results depend on multiple factors including your business practices, market conditions, and customer behavior.
5.3 Service Limitations
- AI may occasionally misunderstand complex enquiries
- Integration capabilities depend on your existing systems
- Service quality requires clear business information from Client during setup
6. Client Responsibilities
6.1 Information Provision
Client must provide:
- Accurate business information for AI training
- Access to necessary systems for integration
- Timely responses during setup and optimization
- Updated information when business details change
6.2 System Requirements
Client is responsible for:
- Maintaining compatible systems for integration
- Providing necessary login credentials and access
- Ensuring third-party services (booking systems, CRMs) remain active
6.3 Compliance
Client warrants that their use of Services complies with all applicable laws and regulations in their jurisdiction.
7. Data and Privacy
7.1 Data Collection
Current AI Solutions collects and processes call data, customer enquiries, and appointment information as necessary to provide Services.
7.2 Data Ownership
Client retains ownership of all customer data. Current AI Solutions uses this data solely to deliver Services.
7.3 Data Security
We implement reasonable security measures to protect Client data, including encryption and secure storage. However, no system is completely secure, and Client acknowledges inherent risks in electronic data transmission.
7.4 Data Retention
Upon cancellation, Client data is retained for 90 days then permanently deleted unless Client requests earlier deletion or extended retention.
7.5 Confidentiality
Both parties agree to keep confidential information obtained through this relationship private and use it only for purposes of this agreement.
8. Intellectual Property
8.1 Ownership
Current AI Solutions retains all rights to:
- AI technology and underlying systems
- Software and proprietary methods
- Service improvements and developments
8.2 License Grant
Client receives a non-exclusive, non-transferable license to use Services during the active subscription period.
9. Limitation of Liability
9.1 Maximum Liability
Current AI Solutions' total liability for any claims arising from Services shall not exceed the total fees paid by Client in the 12 months preceding the claim (or $797 if Client has paid less than 12 months of fees).
9.2 Excluded Damages
Current AI Solutions is not liable for:
- Lost profits, revenue, or business opportunities
- Indirect, incidental, or consequential damages
- Damages resulting from third-party integrations or services
- Customer complaints or lost customers
- Data loss due to Client's failure to maintain backups
9.3 Force Majeure
We are not liable for delays or failures due to circumstances beyond reasonable control (natural disasters, internet outages, third-party service failures, etc.).
10. Warranties and Disclaimers
10.1 Service Warranty
Services are provided "as is" and "as available." We strive for quality but make no warranties regarding:
- Uninterrupted or error-free operation
- Specific business results or outcomes
- Compatibility with all third-party systems
10.2 Client Warranty
Client warrants that:
- They have authority to enter this agreement
- Their business operates legally
- Information provided is accurate and complete
11. Indemnification
Client agrees to indemnify and hold harmless Current AI Solutions from claims arising from:
- Client's use of Services
- Client's violation of these Terms
- Client's violation of applicable laws
- Content or information Client provides
12. Modifications to Terms
Current AI Solutions may modify these Terms at any time. Changes take effect 30 days after notice is sent to Client's email address on file. Continued use of Services after changes constitutes acceptance.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Western Australia.
13.2 Resolution Process
Before initiating formal proceedings:
- Client must notify us in writing of the dispute
- Both parties agree to negotiate in good faith for 30 days
- If unresolved, disputes will be handled through mediation or courts in Perth, Western Australia
14. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between Client and Current AI Solutions regarding Services.
14.2 Severability
If any provision is found unenforceable, remaining provisions continue in full effect.
14.3 No Waiver
Failure to enforce any right or provision does not constitute a waiver of that right.
14.4 Assignment
Client may not assign this agreement without written consent. Current AI Solutions may assign to affiliates or in connection with a business sale.
